Terms of Service

Introduction

Welcome to CityBot ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Service") govern your use of our mobile application CityBot (together or individually "Service") operated by CityBot.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements and agree to be bound by them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know via our Contact page so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use Service.

Copyright and Trademark

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of CityBot and its licensors. The Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of CityBot.

User Content and Social Media

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

By posting Content on or through Service, you represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.

You retain any and all of your rights to any Content you submit, post, or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. However, by posting Content using Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms.

CityBot has the right but not the obligation to monitor and edit all Content provided by users.

If you connect your social media accounts (such as Google, Facebook, or Apple) to our Service for authentication purposes, we may access basic profile information as described in our Privacy Policy. We do not post on your behalf or access your social media contacts without your explicit consent.

Objectionable Content

You agree not to use the Service to upload, post, or otherwise transmit any content that is objectionable, including but not limited to content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. We reserve the right to remove any content that we determine, in our sole discretion, to be objectionable or in violation of these Terms. We also reserve the right to terminate your access to the Service if you repeatedly post objectionable content.

Service Rules

You agree not to engage in any of the following prohibited activities:

  1. Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated "scraping".
  2. Using any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Service.
  3. Transmitting spam, chain letters, or other unsolicited email.
  4. Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  5. Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
  6. Uploading invalid data, viruses, worms, or other software agents through the Service.
  7. Collecting or harvesting any personally identifiable information, including account names, from the Service.
  8. Using the Service for any commercial solicitation purposes.
  9. Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding, or attempting to hide your identity.
  10. Interfering with the proper working of the Service.
  11. Accessing any content on the Service through any technology or means other than those provided or authorized by the Service.
  12. Bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.
  13. Submitting false, misleading, or fraudulent civic issue reports.

Use of AI Technology

Our Service uses artificial intelligence technology, specifically Google's Gemini Pro Vision, to analyze images of civic issues submitted by users. By using the Service, you acknowledge and agree that:

  1. Images you submit may be processed by third-party AI services to generate descriptions and categorize civic issues.
  2. AI-generated descriptions may not be perfectly accurate and should be reviewed before submission.
  3. We are not responsible for any inaccuracies in AI-generated content.
  4. Your use of AI features is subject to the terms and policies of our AI service providers.

NOTICE AND PROCEDURES FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

We respect the intellectual property rights of others and expect our users to do the same. We will respond to clear notices of alleged copyright infringement that comply with applicable law. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) an electronic or physical signature of the owner of the copyright or the person authorized to act on the owner's behalf; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Service; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

CITYBOT, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

IN NO EVENT SHALL CITYBOT, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

International Use

The Service is controlled, operated, and administered by CityBot from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the CityBot Content accessed through the Service in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Indemnity

You agree to defend, indemnify, and hold harmless CityBot and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) Content posted on the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

Entire Terms

These Terms constitute the entire and exclusive understanding and agreement between CityBot and you regarding the Service, and these Terms supersede and replace any and all prior oral or written understandings or agreements between CityBot and you regarding the Service.
